INSOLVENCY & BUSINESS RESCUE

The Companies Act, 71 of 2008, (the Act) came into effect on May 1, 2011 with the purpose of assisting to grow companies across all sectors of the economy and provide for the efficient rescue and recovery of financially distressed companies.

Business rescue is proceedings that are initiated by the directors of a company or affected person(s) to facilitate the financial rehabilitation of a company that is financially distressed. This can either be done by way of resolution or an application to the court.

A company is financially distressed if it appears to be reasonably unlikely that the company will be able to pay all of its debts as they become due and payable within the ensuing six-month period or the company will become insolvent within the ensuing six-month period.

We will assist you in the proper procedure to go about recovering your company in distress.

Conveyancing

Conveyancing is the legal process whereby ownership in immovable property is transferred from one party to another. Each time a property is sold; a new deed of transfer must be drawn up and registered. This is to ensure the security and certainty of an owner’s title to his property. Conveyancing also involves various other acts such as the registration of a bond or a real right over the property.

The seller usually appoints a Conveyancer to attend to the transfer of fixed property, although this, like other aspects of a sale agreement, can be varied by negotiation between the parties. Regardless, of who appoints the conveyancer, the conveyancer owes a duty of care to both parties and must represent both parties fairly.

Managing Director

Abdul was admitted in 2008 and worked at Savage Jooste and Adams Inc until 2015. He then completed his MBA and launched AQ Osman Inc in 2016. He has many years of commercial law and commercial litigation experience. He now also specializes in Trust Administration and Business Rescue.

Lateefa Kader

candidate attorney

Lateefa graduated from the University of Pretoria, with an LLB. She has experience working as an article clerk. During such time she worked on family law matters, labour law, RAF claims and general litigation. She has experience with drafting of company policies and chairing disciplinary hearings. She began working as a candidate attorney for AQ Osman Inc. in the beginning of 2020. She is currently finished with her articles and is in the process of being admitted as an attorney.
